By accessing or using this website, mobile application or other HEART TECH PLUS product or service (collectively the “Platform”) on any computer, mobile phone, tablet, console or other device (collectively, “Device”), you signify that you have read, understand and agree to be bound by these Terms of Use and any other applicable law, whether or not you are a registered member of HEART TECH PLUS. HEART TECH PLUS may change these Terms of Use at any time without notice, effective upon its posting to the Platform. Your continued use of the Platform shall be considered your acceptance to the revised Terms of Use. If you do not agree to these Terms of Use, please do not use this Platform.
The Platform may include features that promote physical activity. Consider the risks involved and consult with your medical professional before engaging in any physical activity. HEART TECH PLUS is not responsible or liable for any injuries or damages you may sustain that result from your use of, or inability to use, the features of the Platform.
HTP customers, prospective customers, and partners provide personal information in conjunction with the use of HTP products and services. HTP does not share personally identifiable information with anyone other than authorized representatives of the customer providing the information except as provided below.
For HTP customers we collect a variety of information, including customer name, mailing addresses, phone number, email address, and other customer information.
HTP collects a user’s location while performing a workout. This location information is used to create a map of the user’s workout for the user’s personal use and is neither stored on HTP servers nor shared with any other users.
HTP customers provide HTP with personally identifiable data about participants using HTP products and services, including the participant’s name, email addresses, various assessment measurements defined by the customer, and other information.
The personal information we collect allows our employees, contractors, and representatives to support HTP customers using HTP products and services.
Customers are provided with access to the identifiable data about participants using HTP products and services as part of the HTP services. Customers only have access to personally identifiable information the HTP customer or their participants provide to us.
We also use personal information provided by HTP customer employees and representatives to help us develop, deliver, and improve our products, services, content, and advertising. We may also use personal information for internal purposes such as auditing, data analysis, and research to improve HTP’s products, services, customer communications, and marketing. These uses of personal information pertain only to the HTP customer and customer employees and representatives and do not apply to student participants enrolled in K-12 educational programs.
We do not collect, maintain, use or share student personal information beyond that needed for authorized educational/school purposes, or as authorized by the parent/student.
We do not sell student personal information.
We do not use or disclose student information for behavioral targeting of advertisements to students.
We do not build a personal profile of a student other than for supporting authorized educational/school purposes or as authorized by the parent/student.
We will not make material changes to our privacy policies without first providing prominent notice to the HTP customers and allowing them choices before data is used in any manner inconsistent with terms they were initially provided; and not make material changes to other policies or practices governing the use of student personal information that are inconsistent with contractual requirements.
We will not knowingly retain student personal information beyond the time period required to support the authorized educational/school purposes, or as authorized by the parent/student.
We collect, use, share, and retain student personal information only for purposes for which we were authorized by the educational institution/agency, teacher or the parent/student.
We maintain a comprehensive security program that is reasonably designed to protect the security, privacy, confidentiality, and integrity of student personal information against risks – such as unauthorized access or use, or unintended or inappropriate disclosure – through the use of administrative, technological, and physical safeguards appropriate to the sensitivity of the information.
The data we collect is stored on secure servers located in the United States.
You may use the content only for your own non-commercial use to participate in the Platform or to place an order or purchase HEART TECH PLUS products. You agree not to change or delete any ownership notices from materials downloaded or printed from the Platform. You agree not to modify, copy, translate, broadcast, perform, display, distribute, frame, reproduce, republish, download, display, post, transmit or sell any Intellectual Property or Content appearing on the Platform, including User Generated Content (defined below), without HEART TECH PLUS’s prior written consent, unless it is your own User Generated Content that you legally post on the Platform. You agree not to use any data mining, robots, scraping or similar data gathering methods. Nothing in these Terms of Use shall be interpreted as granting any license of intellectual property rights to you.
All orders placed through the Platform are subject to HEART TECH PLUS’s acceptance. This means that HEART TECH PLUS may refuse to accept or may cancel any order, whether or not the order has been confirmed, for any or no reason, and without liability to you or anyone else. If your credit card has already been charged for an order that is later cancelled, HEART TECH PLUS will issue you a refund.
You are responsible for any actions that take place while using your HEART TECH PLUS account. Keep your username/password secure and do not allow anyone else to use your username/password to access the Platform. HEART TECH PLUS is not responsible for any loss that results from the unauthorized use of your username/password, with or without your knowledge.
